Commissioner Mizerek opened the meeting at 7:30pm

Police Report

Capt. Jacobs introduced himself to the Commissioners and the audience. He as been assigned from the 5th District. Lt. Burke stated that he was handling operational control of PSA 205 and 206 as Lt. Hayes has been detailed to the Training Academy. Lt. Durbin has administrative control for 205. Cpt. Jacobs stated that all Lts. and above will be issued cell phones

Commissioner Ritzenberg stated that people have had trouble reaching people at 2D. Capt. Jacobs stated that a new voice mail system should be operational soon.

Commissioner Lively requested that Lt. Burke check and see if the department had any extra radar guns that the residents could use to aid the police department in slowing down traffic.

Sgt. Brown gave an update on the stabbing death that took place in front of JP’s nightclub. No new information was available at the meeting. However, Sgt. Brown passed out a flier with a description of a suspect in the stabbing death.

Commissioner Breeden asked if the stabbing involved clients of JP’s nightclub.

Sgt. Brown stated that he could not comment as the case was still under investigation.

Sgt. Brown passed out information on the new 311-phone system. This is a number to use to request non-emergency police help. Sgt. Brown stressed that if anyone was unsure of whether or not to use 911 vs. 311 to err on the safe side and call 911.

Lt. Burke stated that the Smart Machine, which monitors vehicle speed, was out of order and as soon as it could be repaired it would be dispatched to PSA 205.

Liquor License Moratorium

Milt Grossman stated that the Glover Park Citizens Association as did ANC 3B, voted to support a three year liquor license moratorium excluding Class DR License that would allow restaurants to serve beer and wine. Mr. Grossman will prepare a draft for the Commissioners to review.

CVS Update

Mr. Grossman stated the he has not received a response to his latest letter to Mr. Lourenco at DCRA.

Commissioner Procida provided the Commissioners with a letter he would like to be sent to DCRA assuring that CVS allow customers to use the rooftop parking.

Approval of Letter to DCRA regarding Rooftop Parking at CVS

A motion was made, seconded, and passed (5-0-0)

Commissioner Lively stated that he went to DCRA and CVS had not received a permit to work on public space in front of the site. Also the permits that have been issued do not contain the provision that CVS not use trucks larger than 30 feet.

Commissioner Breeden stated that the building permit that has been issued cannot prevent CVS from using trucks larger than 30 feet once the construction is completed. She stated that the Occupancy Permit needs to have the truck limitation listed on it.

Commissioner Ritzenberg stated that ANC3B should contact Councilmember Ambrose and inform her of the lack of response from DCRA.

Commissioner Lively stated that Councilmember Ambrose and her staff are having the same problem with DCRA. Her office as of the first week of January had not received a response for a request for information that was sent to DCRA in November 1999.

Cancer Legislation before the City Council

Victoria Wells, American Cancer Society, requested support of ANC 3B of two bills before the City Council need support:

1. Bill 13-45 "District of Columbia Cancer Prevention Amendment Act of 1999", which would allow woman to have in-patient insurance coverage for inpatient hospitalization after surgery for mastectomy as well as breast reconstruction surgery.

2. Bill 13-60 "Enforcement of the Prohibition of Tobacco Product Sales to Minors Act of 1999" which would prevent advertising of Tobacco products near schools and playgrounds.

Ms. Wells also stated that there is a Tobacco Settlement Bill 13-589 that will come before the council April 6, 2000.

Commissioner Ritzenberg stated that ANC 3B should study the Tobacco Settlement Bill further and report to the community at a later ANC 3B meeting.

ANC 3B Support for Bill 13-45 and 13-60

A motion was made, seconded, and passed (5-0-0)

Bus Issues

Commissioner Breeden stated that she will attend the March 1, 2000 hearing to present comments from Glover Park and Cathedral Heights residents on the D2 route and the new small busses and report back to ANC 3B at the March 9, 2000 meeting.

Snow Removal

Commissioner Breeden stated that she will send a letter to The Office of the Mayor and Councilmember Schwartz on the lack of snow removal by residents and property managers on sidewalks. She will address the fine structure, and the lack of clear regulations in the DC Code that define responsibility and time frame for snow removal.

Commissioner Lively stated that the fine should be tied the property tax bill therefor compelling the property owners to take responsibility for the snow removal.

Water Main break at 39th Street and Tunlaw Road.

Commissioner Breeden stated that the lack of a clear response and an unacceptable time frame for repairing the water main break needs to be addressed.

Commissioner Ritzenberg will find someone at the Water and Sewer Authority to address these issues and come to the March ANC 3B Meeting.

DC Public Schools

Commissioner Breeden stated that Arlene Ackerman would be able to attend a meeting of ANC 3B in May. Commissioner Breeden suggested that other ANC’s and the Stoddert PTA be notified as well to address school issues.
